一、《中华人民共和国婚姻法》规定，在中国结婚，男不得早于22周岁，女不得早于20周岁。

　　二、申请人应办理未婚无配偶声明书公证、认证：
　　1、在当地公证员（NOTARY PUBLIC）办理未婚无配偶声明书（AFFIDAVIT  OF   SINGLE   STATUS）公证。该证明书须写明当事人出生时间、地点、护照号码及婚姻状况；。
　　2、向本州州务卿（Secretary of State）申办认证（部分州要求先向COUNTY CLERK申请认证，再申办州务卿认证） 。
　　3、向中国驻美使馆或总领馆申办认证（申请人应向居住地所属领区的使馆或总领馆提交申请）。驻休斯敦总领事馆领区为美南八州：阿拉巴马（Alabama）、阿肯色（Arkansas）、佛罗里达（Florida）、佐治亚（Georgia）、路易斯安（Louisiana）、密西西比（Mississippi）、俄克拉荷马（Oklahoma）、德克萨斯（Texas）。仅有经上述州州务卿办公室认证过的文件方可送中华人民共和国驻休斯敦总领事馆认证（各州州务卿办公室联系方式附后）。

         4、提供已经美方认证的文件原件及完整复印件一份，并填写《公证认证申请表》（G 1）一份。（文书公证后应在3个月内办理中国使馆或总领馆认证。）
        5、提供申请者身份证件复印件一份，如护照或驾照或其他身份证件。
　　三、办理方式、时间和费用
　　（1）到馆申请：可亲自办理或委托他人到大使馆或总领馆办理，不必提前预约。办理时间为4个工作日，每份20美元；加急申请，1个工作日，每份另加收30美元加急费，2至3个工作日，每份另收20美元加急费。

                  请在取件时用现金、Money Order或 Cashier’s Check （收款人为Chinese Consulate）支付办理费用。
　　（2）邮寄申请：申请人可通过邮寄向住地所属领区的大使馆或总领馆办理。文件到达馆后处理时间为7-14个工作日；除办证费外，每份邮件（包）加收5美元服务费，并附自付邮资的回邮信封（Express Mail或Priority Mail）。请务必阅读邮寄申请须知。邮寄申请只能以Money Order或 Cashier’s Check （收款人为Chinese Consulate）支付费用。 

        四、每人只能办一份未婚/无配偶声明认证。认证书自出证之日起有效期为6个月。

　　* 离婚或丧偶者，除办理未再婚声明书公证认证外，须同时按上述程序办理离婚证明或原配偶死亡证明的公证认证。
　　* 持美国法院离婚判决书的离婚者，如本人或其原配偶系中国公民，应先向中国法院申请裁定承认离婚判决。
